Privacy Notice.

This is the Privacy Notice for clients of Better Call Hit mind, S.A. de C.V. (Hereinafter “HITMIND”). In compliance with the Federal Law on the Protection of Personal Data Held by Individuals (hereinafter the "Law"), its Regulations and other applicable provisions, and in order you to be able to decide in an informed manner about the treatment we can give to your personal data, we provide you with this document that gives information on the use of your personal data when you browse our website www.hitmind.mx, or when you receive any of our services as our client.

Responsible for your personal data.

HITMIND (hereinafter and indistinctly the "Responsible" or "HITMIND") is the controller of your personal data. Our address to hear and receive notifications is:

Use and request of personal data.

To fulfill the purposes described in this notice, HITMIND collects or may collect the following categories of personal data:

  • Identification and contact data.
  • Data of personal characteristics.
  • Financial and insurance economic data.
  • Data of social circumstances.
  • Web search data and devices.
  • Identification and contact data of legal representatives.

Sensitive Data.

HITMIND does not request sensitive personal data (such as health data) to browse or to provide our services. As a client of HITMIND, you must refrain from providing this type of information to HITMIND.

Personal data of third parties.

If you provide HITMIND with personal data of third parties (for example, contacts or family members) for the fulfillment of the purposes identified in this Privacy Notice, you must inform them about the existence of the processing of your personal data and the content of this Privacy Notice. If you provide personal data of third parties, you state that you previously have the consent of their owners to provide their information to HITMIND and that they are correct and complete.

Personal data of minors.

For the purposes established in this Privacy Notice, HITMIND does not request data from minors (individuals, under 18 years of age). If through any means (including on our website) any person provides personal data of minors and HITMIND is aware and certain of such fact, we will proceed to eliminate this information immediately.

Purposes of the processing of personal data.

HITMIND  may process your personal data for two types of purposes: primary and secondary.

Primary purposes:

  • Management control and administration of information requestors (such as quotes) generically known as potential clients.
  • Provide potential clients who request information about the characteristics of the services.
  • Manage, confirm, modify or cancel the provision of the service.
  • Carry out validations on the veracity and quality of the information provided to HITMIND.
  • Management, control and administration of HITMIND clients, whether they are natural persons or legal representatives and contacts designated by legal entities.
  • If requested, manage your registration in our electronic communication channels.
  • Billing of the services offered by HITMIND.
  • Judicial and extrajudicial collection of debts in favor of HITMIND.
  • Participate and assist in compliance with legal provisions on prevention and identification of operations with resources of illicit origin, anti-corruption and other applicable regulations; through the implementation of administrative and technical procedures established for such purposes.
  • To comply with judicial or administrative obligations and requirements, including the delivery of information on fraud or identity theft.
  • Archive of information on the provision of services for compliance with applicable legal provisions, including the defense of the interests of HITMIND before judicial or administrative instances.
  • Statistics and historical record of clients and potential clients.

If you have not expressed your opposition at the time of providing your data to HITMIND, we may process your personal data for the following:

Secondary purposes:

  • To send market, commercial, advertising, promotional and informative communications, as well as personalized offers based on your interests and background as a client or potential client, related to HITMIND services. Such communications include the sending of emails, SMS, telephone calls and other forms of electronic or postal communication.
  • Surveys of satisfaction, consumer habits and/or quantitative and qualitative studies (market research).
  • To send and follow up invitations for events, exhibitions, presentations, contests, promotions, dynamics or other types of activities organized or sponsored by HITMIND.

If you change your mind, you can oppose the processing of your personal data for the aforementioned secondary purposes, and even revoke your consent for such purposes. In such cases, you may communicate your decision through the procedure provided in the "ARCO Rights" section of this Privacy Notice.

The refusal to use your personal data for secondary purposes may not be a reason for HITMIND not to provide the services offered by us.

Transfer of your data.

HITMIND may share your personal data and carry out transfers of personal data under the terms of the Law and this Privacy Notice, both inside and outside of Mexico, in the following cases and for the following purposes:

  • Towards our subsidiaries and/or affiliated companies or any company of the same corporate group as HITMIND that operates under the same internal processes and policies, for purposes of management, administration and centralized safeguarding of information, including actions to control registrations, cancellations and update of data in your file as a client; compliance with information obligations, transparency, prevention of illicit activities, as well as non-compliance with obligations of sectoral regulations; communication of reports, evaluations, reports, internal and external audits to management bodies of the corporate group of HITMIND, as well as statistical and historical record purposes of HITMIND's clients.
  • Banks or other financial entities for the fulfillment of payment obligations.
  • Service providers and business partners, to complete the acquisition of services provided by HITMIND.
  • Public entities, federal, state and/or municipal public administrations, commissions, institutes and/or regulatory entities, for compliance with information, transparency and prevention of illicit activities obligations, as well as for compliance with judicial or administrative requirements issued by competent authorities.

The Law establishes that the aforementioned data transfers do not require your consent in order to be carried out. Any transfer of your personal data that does require your consent will be previously informed, through the communication and updating of this Privacy Notice and prior to the realization of that data communication.

ARCO Rights.

The Law regulates the ARCO rights that you have as the owner of personal data. These rights include:

  • Access: the right to know what personal data we process about you, as well as information regarding the conditions and generalities of the treatment.
  • Rectification: the right to request at any time the rectification of your data that is inaccurate or incomplete.
  • Cancellation: the right for HITMIND to cancel the processing of your personal data, from a block and subsequent deletion.
  • Opposition: the right to oppose, for legitimate reasons, the processing of your personal data.

To execute any of the ARCO rights, you must submit a request addressed to our personal data division, through any of the following channels:

  • Sending a request to the email address [email protected]; or

The request must contain or be accompanied by:

  • Your full name and address, or other means to communicate the response to your request.
  • Copy of a document that proves your identity and, if applicable, legal representation if someone exercises the right on your behalf. You may waive this requirement if you provide information that proves you as a HITMIND client and indisputably identifies you.
  • A clear and precise description of the ARCO right that you wish to exercise and of the personal data related to your request; and
  • If applicable, any other information or document that helps us locate your personal data.

HITMIND will respond to your request within 20 business days from the date it is sent and received. If the request is appropriate, HITMIND will make it effective within 15 business days following the date on which the response is communicated. In the event that the information and/or documentation provided in your request is incomplete, erroneous and/or insufficient, or the necessary documents are not attached to prove your identity or the corresponding legal representation, HITMIND will request the correction of deficiencies in order to process your request. You will have 10 business days to meet the request and correct it; otherwise, it will be considered as not presented.

The use of electronic means for the exercise of ARCO rights authorizes HITMIND to respond to the corresponding request through the same means, unless you indicate clearly and expressly another means of contact in your request.

The right to cancel is not absolute. Please note that HITMIND must retain information to comply with its various legal obligations and may share your personal data with other entities or agencies to do so. In such cases, the right of cancellation may have to be requested from the entity that received your personal data.

Revocation of consent or limitation of the use of your data.

You may revoke consent for the processing or transfer of your personal data; this revocation may have the effect that we cannot provide you with some services. If there are causes of public interest or legal obligations related to the security of our clients, we may be able to deny the revocation of your consent for certain purposes.

If you revoke your consent and such revocation is appropriate, HITMIND will stop processing your personal data for the purposes indicated in this Privacy Notice that are appropriate or expressly requested. Notwithstanding the foregoing, the revocation of your consent may not be intended to guarantee that third parties who have had access to your personal data stop processing them immediately, or in the future, because they can use your information for their own purposes and under your own privacy notices.

You may send your consent revocation request to the email [email protected], following the instructions applicable to the exercise of ARCO rights.

You can also limit the use or disclosure of your personal data, directing the corresponding request to our personal data division. The requirements to prove your identity, as well as the procedure to attend to your request, will be the same as those indicated for the exercise of ARCO rights.

HITMIND has means and procedures to ensure the inclusion of some of your data in its own exclusion lists, when you expressly request inclusion in them. In such cases, HITMIND will grant the holders who request their registration the corresponding registration certificate.
